Terms & Conditions
These Terms and Conditions ("Terms") govern the contractual relationship between Joyalukkas LTD ("we", "us", "our") and the consumer ("you", "your") for the sale and purchase of goods via our website and/or mobile application (collectively, the "Platform"). These Terms are legally binding and compliant with applicable legislation including but not limited to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Consumer Rights Act 2015, the Electronic Commerce Regulations 2002, and the Data Protection Act 2018 (incorporating the UK GDPR).1. 2. Contract Formation:
2.1 All orders placed by you are subject to acceptance by us and constitute an offer to purchase goods in accordance with these Terms.
2.2 We reserve the right to reject any order prior to confirmation, including but not limited to circumstances involving:
Product unavailability
Incorrect pricing or product description
Payment authorisation failure
Suspected fraudulent activity or identity verification issues
2.3 You represent that you are legally capable of entering into binding contracts and are at least 18 years of age
3. Product Information and Pricing
3.1 All descriptions and illustrations of products are intended to present a general idea of the goods. Minor variations may occur due to the handcrafted nature of our jewellery.
3.2 All prices listed
Are expressed in British Pounds Sterling (GBP) Includinge Value Added Tax (VAT) at the applicable statutory rate
Exclude delivery charges unless expressly stated otherwise
3.3 Delivery charges, if applicable, shall be itemised and displayed during the checkout process prior to order confirmation.
4. Delivery:
4.1 We offer delivery services within the United Kingdom. Delivery is estimated within 3-4 business days from the order date.
4.2 Delivery shall be executed using reputable third-party courier services.
4.3 Risk of loss or damage passes to you upon delivery. Legal ownership (title) transfers only after full payment has been received.
4.4 We shall not be liable for any delay in delivery due to events outside our reasonable control. In such cases, we will contact you with an updated estimated delivery schedule.
5. Right to Cancel:
(As per Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013):
5.1 You are entitled to cancel your contract within 14 calendar days from the day after you receive the goods without providing any reason as per Consumer Contracts Regulations 2013.
5.2 Cancellation must be communicated to us in writing (email or postal letter), clearly stating your decision to cancel.
5.3 You must return the goods to us within 14 days of notifying us of the cancellation. Items must be unused and in their original, undamaged packaging. Return policy shall not be applicable for custom made, specially ordered or altered products.
5.4 Upon receiving the returned goods or evidence of their return, we will issue a refund (inclusive of standard delivery charges) within 14 days.
5.5 You are responsible for return shipping costs unless the goods are found to be defective or not as ordered
6. Faulty or Non-Conforming Goods (As per Consumer Rights Act 2015):
6.1 You have the right to a full refund if the goods are found faulty, misdescribed, or not fit for purpose, provided this is reported within 30 calendar days of receipt.
6.2 After the 30-day period, you may still be entitled to a repair, replacement, or partial refund depending on the nature of the issue and time elapsed.
6.3 Claims must be substantiated with proof of purchase and, if applicable, videographic evidence of unboxing or photographic evidence of the fault as applicable on a case to case basis.
7. Payment Terms and Security:
7.1 We accept major debit/credit cards and PayPal.
7.2 All transactions are processed using encrypted technology via a secure third-party payment gateway.
7.3 Orders will not be processed or dispatched until full payment is received and authorised by your card issuer.
7.4 We do not retain or have access to your financial information. Your statutory rights remain unaffected in the event of unauthorised card use.
8. Limitation of Liability:
8.1 Nothing in these Terms shall exclude or limit liability for death or personal injury resulting from negligence, fraud, or breaches of statutory consumer rights under the Consumer Rights Act 2015.
8.2 Subject to Clause 8.1,
we shall not be liable for:
Indirect or consequential losses
Economic loss, loss of business or revenue
Any loss not reasonably foreseeable at the time of contract
Losses due to improper use of the goods
9. Complaints and Dispute Resolution:
9.1 In the event of a dispute, please contact our customer services department in the first instance to resolve the issue amicably.
9.2 If you are a consumer residing in the European Union, you may refer your complaint to the Online Dispute Resolution (ODR) platform operated by the European Commission at https://ec.europa.eu/consumers/odr. UK consumers may escalate unresolved disputes through an approved Alternative Dispute Resolution (ADR) body appropriate to the sector, in accordance with the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015."
9.3 We process your personal data in accordance with our Privacy Policy that is compliant with UK GDPR, as required by the Data Protection Act 2018 and UK GDPR.
9.4 Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Cookies:

11. Governing Law:
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
12. Amendments:
We reserve the right to amend these Terms at any time to reflect changes in law or our business operations. Updated Terms will be made available on the Platform and shall take immediate effect upon posting. You can download, print and retain a copy of the Terms and Conditions for your records.
13. Third Party Rights:
No person other than a party to this contract shall have any right to enforce any term of this agreement pursuant to the Contracts (Rights of Third Parties) Act 1999.
